If you do not agree with any part of these terms, please do not use our services or website. We reserve the right to modify these terms at any time, with changes becoming effective upon posting to our website.
2. Definitions
For purposes of these Terms and Conditions:
- "We," "Us," "Our" refers to Terranova Legal, a legal services provider registered in Taiwan
- "You," "Your," "Client" refers to individuals or entities engaging our services
- "Services" refers to immigration consultation, application support, and related legal services we provide
- "Website" refers to all web pages, content, and functionality accessible through our domain
- "Agreement" refers to the contract formed when you engage our services
3. Service Description
Terranova Legal provides immigration and residency services for individuals seeking to establish presence in Taiwan. Our services include:
- Immigration pathway consultation and assessment
- Visa and residency application preparation and submission
- Document coordination and translation services
- Business establishment support for entrepreneurial visas
- Multi-agency coordination for complex immigration matters
Specific services provided will be outlined in individual engagement agreements. Service availability may vary based on current Taiwan immigration regulations.
4. Eligibility and Capacity
By engaging our services, you represent and warrant that:
- You are at least 18 years of age or have legal guardian consent
- You have the legal capacity to enter into binding agreements
- You are authorized to provide the information and documentation required
- All information you provide is accurate and truthful to the knowledge available to you
5. Client Responsibilities
When engaging our services, you agree to:
Information Accuracy
- Provide complete and accurate information to the extent you are aware
- Disclose all relevant facts that may affect your immigration application
- Notify us promptly of any changes to your circumstances or information
- Review all documents before submission for accuracy
Documentation
- Provide requested documents in timely manner
- Ensure documents are authentic and legally obtained
- Obtain necessary certifications or apostilles as required
- Maintain copies of all submitted documents
Communication
- Respond to our inquiries and requests promptly
- Maintain current contact information
- Check communications regularly for important updates
- Attend scheduled consultations or notify us of conflicts
Compliance
- Comply with Taiwan immigration laws and regulations
- Follow instructions regarding application procedures
- Pay required government fees and processing charges
- Cooperate with any additional requests from immigration authorities
6. Service Fees and Payment
Fee Structure
Our service fees are outlined on our website and in individual engagement agreements. Current standard fees are:
- Territory Consultation: NT$10,400
- Settlement Services: NT$36,500
- Full Establishment Program: NT$74,000
Additional Costs
Service fees do not include:
- Government application and processing fees
- Translation and certification costs
- Document procurement or courier charges
- Travel expenses if physical presence is required
Payment Terms
Payment terms will be specified in your engagement agreement. Generally:
- Initial consultation fees are due upon scheduling
- Service fees may be structured as deposits and milestone payments
- Payment is required before submission of applications
- Accepted payment methods include bank transfer and approved credit cards
Refund Policy
Fees for completed services are non-refundable. If services are terminated before completion, refunds will be calculated based on work completed and costs incurred. Government fees paid to authorities are non-refundable regardless of application outcome.
7. Service Limitations and Disclaimers
No Outcome Guarantees
We provide professional immigration services based on current laws and regulations. However, we cannot and do not provide assurance of application approval. Immigration decisions are made by Taiwan government authorities based on their assessment of your qualifications and circumstances.
Professional Scope
Our services are limited to immigration and residency matters. We do not provide:
- Tax advice or financial planning services
- Real estate or property services
- Employment placement or job search assistance
- General legal representation outside immigration scope
Regulatory Changes
Taiwan immigration regulations and policies may change. We will make reasonable efforts to inform you of relevant changes affecting your case, but cannot be held responsible for regulatory modifications beyond our control.
Third-Party Services
When we coordinate third-party services such as translations or certifications, we select providers we consider reliable. However, we are not responsible for the quality or timeliness of third-party work beyond our direct control.
8. Confidentiality
We maintain confidentiality of your personal information and case details as outlined in our Privacy Policy. This confidentiality obligation includes:
- Not disclosing your information to unauthorized third parties
- Implementing appropriate security measures for data protection
- Training staff on confidentiality requirements
Exceptions to confidentiality include disclosures required by law or necessary for providing services, such as submissions to immigration authorities.
9. Limitation of Liability
To the maximum extent permitted by law:
- Our liability for any claim related to our services is limited to the fees paid for those specific services
- We are not liable for indirect, consequential, or punitive damages
- We are not responsible for losses resulting from immigration application denials or delays
- We are not liable for circumstances beyond our reasonable control
This limitation applies regardless of the legal theory on which liability might be based, including negligence, contract breach, or other causes.
10. Termination
By Client
You may terminate our engagement at any time by providing written notice. Upon termination, you remain responsible for payment of fees for work completed and costs incurred through the termination date.
By Terranova Legal
We may terminate our engagement if:
- Payment obligations are not met
- You fail to provide necessary cooperation or information
- Continuing the engagement would violate professional obligations
- The engagement becomes impractical due to circumstances beyond our control
Effects of Termination
Upon termination, we will provide you with documents and work product completed to that point. You remain responsible for any ongoing government processes or applications we have initiated on your behalf.
11. Dispute Resolution
Governing Law
These Terms and Conditions are governed by the laws of Taiwan, without regard to conflict of law principles.
Jurisdiction
Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Taipei, Taiwan.
Informal Resolution
Before pursuing formal legal action, parties agree to attempt good faith informal resolution of disputes through direct communication.
12. General Provisions
Entire Agreement
These Terms and Conditions, together with any engagement agreement and our Privacy Policy, constitute the entire agreement between you and Terranova Legal regarding our services.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver
Failure to enforce any provision of these terms does not constitute a waiver of that provision or our right to enforce it in the future.
Assignment
You may not assign your rights or obligations under these terms without our written consent. We may assign our rights or delegate our obligations to qualified professionals.
Notices
Legal notices should be sent to [email protected] or to our registered office address. Notices are considered received when delivered by email or three business days after mailing.
13. Changes to Terms
We may update these Terms and Conditions to reflect changes in our services, legal requirements, or business practices. Changes become effective when posted to our website with an updated "Last Updated" date.
Continued use of our services after changes indicates acceptance of the updated terms. For significant changes, we may provide direct notification to active clients.
